The firm's trusts and estates group represents individuals and their families in planning for and implementing transfers of wealth. The estate planning practice includes but is not limited to representing high net worth individuals and their families. It consists of not only traditional testamentary planning through wills and living trusts but also more complex lifetime gifting techniques, personal tax planning, pre- and post-marital agreements, retirement planning, planning for special needs situations, conservatorships and guardianships, asset protection planning, family business succession planning, and charitable giving, all designed to coordinate a client's particular needs and desires with the least disruptive and most tax-efficient way to achieve them.
In addition, the trusts and estates group represents fiduciaries and family members in implementing estate plans post-mortem, including marital deduction funding and elections, fiduciary income tax planning, estate and inheritance tax compliance, resolutions of controversies with taxing authorities, and general probate administration. In conjunction with the civil litigation group, the trusts and estates group participates in will contests and other estate and trust litigation.
